Our company, PROCESSTAILOR ENGINEERING LIMITED (hereinafter referred to as "PROCESSTAILOR" or the "Company"), is an international engineering service provider that organizes live online courses and conferences in various business areas. We understand that you care about your privacy interests and act responsibly with respect to your rights. This privacy policy   applies to your use of the websites located at https://processtailor.com and https://processtailor.com.tr ("Websites") and explains how the personal data received from the users of the Websites and our customers is processed.

The Company acts as a data controller in accordance with the Law on the Protection of Personal Data No. 6698 ("KVKK") while controlling the data collection methods and determining the purposes for which personal data will be used.

This Policy applies to individuals whose personal data is or may be processed by us as data controllers, including, but not limited to, using our Websites, submitting a registration form, contacting us with questions, following a link to this Policy, participating in our events.

  1. You are hereby informed by PROCESSTAILOR about the processing of your personal data by the means and purposes set out herein;

  2. You give your consent to the Company to process your personal data for marketing purposes. You can unsubscribe or withdraw your consent at any time by contacting us or by clicking on the "Unsubscribe" button in our emails.

We do our best to protect all personal data received from our customers and users of the Websites and comply with all national data protection laws to the extent applicable to us. We are responsible for maintaining and updating our data processing procedures to comply with legal requirements for privacy and security reasons. You should read this Policy regularly as we may need to change it from time to time. Your use of the Website and our services after such changes will mean that you accept these changes.

If you do not agree to the processing of your personal data, we ask you not to transmit your personal data to us through the Websites. Under applicable law and this policy, you can request that we delete your personal data at any time.

1. What personal data we collect and how we receive it

We collect only the information about you that is necessary to allow you to use the Websites, provide our services, and respond to your requests, only to the extent specifically set out in this Policy. When you sign up for our newsletter or promotions, you consent to us collecting your name and contact information. In addition, our Company may process other personal data if you voluntarily provide it to us.

1.1 Information we collect from you when providing our services

The personal data that we may receive and process from you in the course of providing our services includes:

Name and surname;

Contact record, your email address, telephone number, mailing address;

Your date of birth;

Your place of work or study and position;

Photo and video with your participation;

Contact record;

Data collected from the feedback form or survey.

You provide this data mainly when registering and participating in our training events and when communicating with our service support team.

Please note that we conduct customer satisfaction surveys related to our services. These surveys can be carried out through various communication channels (email, calls, and WhatsApp, etc.). We generally record communications with you and your responses to survey questions. If you give us your permission, we may publish your feedback in particular on the Websites or in our Company's marketing activities.

1.2 Information we may obtain in the course of your use of our Websites

When you use our Websites, we may collect the following information about you:

Information about your device(s), in particular hardware model, information system version and mobile network information;

Internet protocol address (IP address);

Browser version and browser setting;

Customer account information, such as username and password for authentication and access;

Details about how you use our Websites (using our cookies and similar technologies).

We may use "cookies" to help us administer the Website and provide you with functionality and customized messages. For more information about cookies, you can refer to our Cookie Policy and use our cookie tool to select your preferences.

1.3 Information we obtain from your enquiries or from the registration form you have completed

When you fill out a registration or contact form to inquire about our services, we ask for your full name, email address and phone number. We need your contact information to provide you with the answers and information you request. We may contact you through various communication channels such as email, call, WhatsApp, SMS, social media, etc.

Once we have started communicating with you, we may receive and store additional information about you, including personal data. In particular, we may record and store our communication with you (recording of telephone calls or correspondence via email, WhatsApp, etc.).

1.4 Processing of information received from third parties

From time to time, our company may collect personal data about you from third parties. This may be the case in particular if our training services are ordered and paid for by your employer and/or professional association. We may also receive your personal data from a third-party platform/website if you provide a relevant link to your profile during registration (e.g. Facebook, LinkedIn, etc.).

Our company may also collect information about potential customers from third parties in order to determine the demand for our services in the market and to make changes to our marketing strategy. Such information collected is non-identifiable data (e.g. age, industry, country groups, etc.) and is not considered personal data.

1.5 Processing of children's personal data

Please note that our Websites and services are not directed to anyone under the age of 18. Therefore, we do not knowingly collect or process information about children. If you become aware that our Websites are being used by children or that we are receiving data from children without parental consent, please notify us immediately. Next, we will take the necessary steps to remove this information.

1.6 Processing of sensitive personal data groups

The Company does not collect any data on racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetics, biometrics, health data, or any other data relating to a person's sexual life or sexual orientation through these Websites.

2. Purposes and legal basis of data processing

The Company processes your data only in accordance with applicable law. We process personal data on this legal basis for the following purposes (Data may be processed on more than one legal basis):

To register the User on the Websites, create a personal account and provide access to our Website services, including, but not limited to, our educational online events, trainings and courses (conclusion and/or performance of the contract);

To provide services that you have requested from us or that we think may be of interest to you (performance of a contract, legitimate interest);

Maintain our website, including the educational platform for our services (performance of contract, legitimate interest);

To inform you, the customer, of changes to our services and other announcements (performance of contract, legitimate interest);

To comply with our other obligations when providing our services in accordance with our terms of use (performance of contract, in some cases legitimate interest);

Conduct internal research, development, testing, and improvement of the features and functionality of our Services (legitimate interest);

To establish and maintain communication between the Company and the user in order to provide advice on the Services, to provide technical support regarding the use of the Websites, if any, and to fulfill user/customer requests;

To process (consider) and respond to user/customer requests or complaints (consent, legitimate interest);

To improve the quality of the Company's Services for Customers and users of the Websites (legitimate interest, in some cases consent);

Comply with our internal and external audit requirements, including our information security measures (performance of contract, legitimate interest);

To protect against malicious actions of users (fraud, etc.), to detect and/or investigate a crime in connection with other security aspects of the company (legitimate interest, compliance with legal requirements);

Analytical and statistical purposes (legitimate interest);

Request your feedback or participation in surveys (legitimate interest, consent);

Marketing purposes (consent);

Personalizing the experience of the website user and providing the type of content that may be of most interest to you (consent, in some cases legitimate interest);

Respond to requests from supervisory and law enforcement authorities (compliance with legal requirements);

To ensure other legitimate interests of the Company, e.g. to prepare a request (legitimate interest).

If we rely on legitimate interests as a legal ground for processing your personal data, we will balance those interests with your interests, fundamental rights and freedoms in accordance with the requirements of applicable law and industry best practices.

If the purpose of processing some data changes, we will obtain additional consent from you.

3. Marketing Preferences

The Company may provide you with promotional information in a variety of ways, including by email, telephone, text message, and online (while using the website).

It is essential for us to respect your marketing preferences and the requirements of applicable data protection laws. We send you advertising materials with your explicit consent or if we have a legitimate interest in direct advertising.

Direct marketing should not promote information that is contrary to your interests. For example, from time to time, we may introduce Services to you that we think may be of interest to you based on your past interest.

Even if you have previously given us your consent, you can opt out of promotional activities and also object to receiving direct marketing services.

If you decide to opt out of promotions or object to receiving direct advertising from us, you can find an "unsubscribe" button in every advertising email we send or  contact our Global Data Protection Officer at info@processtailor.com.

At the same time, even if you opt out of receiving promotional services, we may send you service messages or important information about transactions related to the services you requested/purchased. This is necessary, among other things, for the purpose of the performance of the contract.

4. Security

The Company implements physical, administrative and technical protection measures for the protection of personal data within the scope of all applicable legislation, including KVKK. We regularly test our security measures to ensure that they remain efficient and effective.

First, we use the usual scan for the detection of malicious programs, our anti-virus protection program is one of the best on the market.

The company adheres to the principle of minimizing data. We grant access to our employees only on a need-to-know basis (who needs access to relevant data in order to perform their functional duties). In addition, we regularly provide training to our employees on our policies regarding data privacy and security.

We use VPN, encryption, and password protection when transferring personal data off-site.

5. Where do we store your personal data and for how long?

Once we have received your information, we will implement all necessary procedures and security measures to prevent unauthorized access, loss, disclosure or alteration of the data received.

Your personal data collected by us is stored in information technology systems and cloud systems owned and operated by the Company.

We retain personal data only for as long as is necessary to fulfil our purposes for which we collected data, including to comply with legal requirements, accounting or reporting, and to ensure the fulfilment of our contracts with customers.

In determining the appropriate retention period for personal data, in addition to the purposes of processing, we also take into account the nature and category of the data, the potential risk of harm from unauthorized use or disclosure of the data, and the relevant requirements of applicable law.

Generally, we retain basic information about our clients for a period of five (5) years after the client relationship ends (for tax and legal purposes).

If the laws of the country of residence of our customers receiving services contain statute of limitations, which determine the period within which you can bring a claim or bring a lawsuit against us, and therefore we need appropriate evidence of a legal relationship with you, we may process your personal data during this period.

Over time, we may minimize or anonymize the data we process about you (for research or statistical purposes) so that the data we process will no longer be personally linked to you. If some data is anonymized, we can use this data almost indefinitely, as it no longer contains personal data.

If we process personal data within the scope of your consent to process it (in particular for marketing purposes), you have the right to withdraw your consent at any time or to request the erasure of the data or the temporary suspension of the processing of the data. 6. Disclosure and transfer of your personal data

We may also share (transfer or provide access to) personal data with third parties, including:

PROCESSTAILOR: We may share your personal data with PROCESSTAILOR partner(s) who work on our behalf and need access to your personal data in order to carry out their business, such as billing, providing customer support, etc.

Vendors, Consultants, and Other Service Providers: We may share your personal data with third-party vendors, consultants, and other service providers who work on our behalf and need access to your personal data in order to carry out their business, such as billing, website maintenance, accounting, providing customer support, CRM system, etc. These service providers are authorized to use your personal data only as necessary to provide services to the company.

State, federal, and other regulatory, administrative, or law enforcement authorities or agencies and courts: We may share your personal data with such third parties when:

(1) If we believe disclosure is reasonably necessary to comply with any applicable law, other regulation or legal process,

(2) If we receive a court order, an administrative authority's decision, or a government request (e.g., search warrant, subpoena, statute, court order, data breach notification, etc.),

(3) To protect the security or integrity of the website,

(4) To protect the Company and our customers from harm or illegal activities.

Other types of third parties: Your personal data

(1) to respond to an emergency situation that we have a good faith belief requires us to disclose information to help prevent death or serious bodily injury to any person, or

(2) We may disclose the data when we receive your request to share it with a specific third party.

We may transfer your personal data to third countries or territories that may have different privacy laws than the country in which you reside (but only if adequate protection is available in the country or territory to which it is transferred). Some recipients of personal data may be based in countries other than Turkey. Please note that the Company transfers your personal data outside of Turkey only if necessary and for the purposes set out in this policy, provided that there is a reasonable assurance that your rights and freedoms as a data subject are protected.

In such cases, we will take adequate security measures in accordance with our legal obligations and applicable law to protect your data. When transferring your data to third countries, the Company uses special agreements on data transfer and processing. In addition, we will require all data recipients to ensure an appropriate level of protection and security of personal data.

You should know that we never sell your personal data to third parties.

In the event of a merger, reorganization or similar corporate event, sale of part of the company/company assets, the information collected by us, including personal data, may be transferred to another company/organization (subject to merger or acquisition). Of course, all such data transfers will be carried out within the scope of applicable data protection legislation and our confidentiality obligations, as set out in this policy.

7. Content/links provided by third parties

On our Websites you will find content and products from other companies or organizations and/or links to the sites and services of our suppliers, licensors or other third parties. We do not control these sites. Each such third party is solely responsible for compliance with the laws, rules and regulations applicable to its business and the operation of the website. We are not responsible for the privacy practices, content, or compliance of such sites or their owners and operators, or with laws and regulations. These sites and services may have their own privacy policies and customer service policies, or they may have no policy(s) at all. We recommend that you review the privacy policies of any third-party sites before providing them with your information.

8. Rights of the data subject

We provide you with the data protection rights stipulated in the KVKK and relevant national laws. In particular, pursuant to Article 11 of the KVKK, you have the following rights as personal data owners:

a) To learn whether your personal data is processed or not,

b) Requesting information about whether your personal data is processed or not,

c) To learn the purpose of processing personal data and whether they are used in accordance with their purpose,

d) To learn the third parties to whom your personal data is transferred at home or abroad,

e) Requesting the correction of incomplete or incorrect data, if any,

f) Requesting the deletion or destruction of your personal data within the framework of the conditions specified in Article 7 of the KVKK,

g) Requesting notification of the transactions made pursuant to subparagraphs (e) and (f) to third parties to whom personal data has been transferred,

h) Contest the occurrence of a result against you by analysing a decision based solely on automated processing;

i) To claim compensation for damages arising from the unlawful processing of your personal data.

Please note that when you contact us, you must go through the identification process and provide your specific requirements before we can process your request and respond on legitimate grounds. If we are unable to identify you via message, or if we have reasonable doubts about your identity, we may ask you to provide proof of your identity. Only in this way can we avoid disclosing your data to someone who could impersonate you, i.e. the identification is carried out in your interests. Any additional information collected for verification purposes will only be used to verify identity.

We process requests as quickly as possible, but please note that providing a complete and legal response is a complex process that can take up to a month or more. We will inform you if we need more time to prepare a reply.
